Welcome to Pick Crunch, operated by Blattman Gaming Co. ("we," "us," or "our"). By accessing or using the Pick Crunch website at pickcrunch.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Pick Crunch is a free sports prediction and league management platform. Users can create or join fantasy-style pick'em leagues, make predictions against published spreads and totals across multiple sports (NFL, NBA, MLB, NHL, NCAAF, NCAAB), and compete on leaderboards. The Service is provided for entertainment purposes only.

3. Account Responsibilities

To use certain features of the Service, you must create an account through our third-party authentication provider (Auth0). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account and to notify us promptly of any unauthorized use.

You must be at least 13 years old to create an account and use the Service.

4. Sports and Entertainment Disclaimer

Pick Crunch is a free-to-play sports prediction platform provided strictly for entertainment purposes. The Service is not a gambling platform, sportsbook, or betting exchange. No real money is wagered, won, or lost through Pick Crunch.

Nothing on this platform constitutes gambling advice, betting recommendations, or financial guidance of any kind. The spreads, totals, odds, and lines displayed on Pick Crunch are sourced from third-party data providers (including The Odds API) and are provided for informational and entertainment purposes only. We make no representations or warranties regarding the accuracy, completeness, or timeliness of any such data.

You acknowledge and agree that any decisions you make based on information displayed on Pick Crunch — including but not limited to decisions to place wagers with third-party sportsbooks — are made entirely at your own risk. Pick Crunch, Blattman Gaming Co., and its affiliates shall not be liable for any losses, damages, or claims arising from your use of the information provided through the Service.

If you choose to gamble, please do so responsibly and in compliance with the laws of your jurisdiction.

5. Third-Party Data and Services

The Service integrates with and relies on third-party services, including but not limited to The Odds API for sports data, Auth0 for authentication, and PostHog for product analytics. We do not guarantee the availability, accuracy, or reliability of any third-party services or the data they provide. Third-party services are subject to their own terms and privacy policies.

6. Intellectual Property

All content, design, graphics, logos, and software associated with Pick Crunch are the property of Blattman Gaming Co. or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Any content you submit to the Service (such as league messages or display names) remains yours, but you grant us a non-exclusive, royalty-free license to use, display, and distribute that content in connection with operating the Service.

7. Acceptable Use

You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) harass, abuse, or harm other users; (c) interfere with or disrupt the Service or its infrastructure; (d) attempt to gain unauthorized access to any part of the Service; (e) scrape, crawl, or use automated means to access the Service without our written permission; or (f) impersonate any person or entity.

8. Paid Services and Future Features

Pick Crunch is currently a free service. We may introduce paid features, premium tiers, API access, or other monetized services in the future. Any such offerings will be subject to additional terms that will be presented to you at the time of purchase. Free access to core features will not be retroactively revoked.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Blattman Gaming Co. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time by contacting us.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in New York, New York.
